Welcome to Montélier (“Montélier”, “we”, “our”, or “us”). These Terms of Service govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms.

1. Eligibility

By using this website, you confirm that you are at least 18 years of age or have the permission of a parent or legal guardian to use this website and purchase our products.

2. Product Information

We strive to ensure that all product descriptions, pricing, specifications and images are accurate. As many of our pieces feature natural diamonds, gemstones and precious metals, slight variations in colour, inclusions, finish, texture and appearance are a natural characteristic of fine jewellery and should not be considered defects.

While every effort is made to accurately display product colours, the appearance of colours may vary depending on your device or monitor settings.

3. Bespoke & Made-to-Order Jewellery

Custom-made, personalised and bespoke pieces are created specifically for you.

Once production has commenced:

  • Orders cannot be cancelled.
  • Deposits are non-refundable.
  • Changes may not be possible.
  • Custom pieces cannot be returned or exchanged unless required by Australian Consumer Law.

Production timeframes are estimates only and may vary.

4. Pricing

All prices are displayed in Australian Dollars (AUD) unless otherwise stated. We reserve the right to change pricing at any time without notice. If a pricing error occurs, we reserve the right to cancel or refuse an order before dispatch and provide a full refund.

5. Payments

Payment must be received in full before production or dispatch unless otherwise agreed in writing. We reserve the right to decline or cancel orders suspected of fraud or unauthorised activity.

6. Shipping

Montélier offers complimentary shipping within Australia and worldwide. Estimated delivery times are provided as a guide only and are not guaranteed. We are not responsible for delays caused by couriers, customs authorities, weather events or other circumstances beyond our reasonable control. Risk in the goods passes in accordance with applicable Australian law and the relevant courier’s delivery terms.

7. Ring Sizing

Customers are responsible for selecting the correct ring size before placing an order. If you are unsure of your size, we encourage you to contact us prior to purchasing. Resizing availability depends on the design of the ring and may incur additional fees. 

8. Care of Your Jewellery

Fine jewellery should be worn and cared for appropriately.

Damage resulting from:

  • Accidental impact
  • Improper care
  • Normal wear and tear
  • Exposure to chemicals
  • Unauthorised repairs or alterations

is not considered a manufacturing fault. We recommend regular professional cleaning and inspections to maintain your jewellery.

9. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law. Where a product fails to meet the consumer guarantees under Australian law, you may be entitled to a repair, replacement or refund.

10. Intellectual Property

All content on this website, including but not limited to:

  • Product images
  • Logos
  • Branding
  • Videos
  • Graphics
  • Website design
  • Written content

is the property of Montélier and is protected by Australian and international intellectual property laws. You must not reproduce, distribute, copy, modify or use any content without our prior written consent.

11. Website Use

You agree not to:

  • Use our website for unlawful purposes.
  • Interfere with the operation or security of the website.
  • Attempt to gain unauthorised access to our systems.
  • Upload malicious software or code.
  • Copy or scrape website content without permission.

12. Limitation of Liability

To the maximum extent permitted by law, Montélier is not liable for any indirect, incidental, consequential or special loss or damage arising from the use of our website or products. Our liability is limited to the remedies available under applicable Australian law.

13. Force Majeure

Montélier is not responsible for delays or failure to perform obligations where such delay results from events beyond our reasonable control, including but not limited to natural disasters, pandemics, industrial disputes, supplier shortages, government actions, customs delays or courier disruptions.
